Terms of Service

1. Parties and Scope

These Terms of Service govern the relationship between MOBIM Software and Consulting Services Inc. ("FieldCo") and the individual or legal entity ("User") using the FieldCo platform. Accessing or using the platform constitutes acceptance of these terms.

2. Service Description

FieldCo is a SaaS (Software as a Service) platform that enables field service teams to digitally manage work orders, field operations, inventory management and customer processes. The service consists of a web application, Android mobile app and iOS mobile app components.

3. Subscription and Payment

  • Subscriptions are billed annually.
  • No credit card required during the 14-day free trial.
  • If no subscription is started after the trial, the account is frozen and data retained for 30 days.
  • Users added during the year are billed pro-rata for the remaining months.
  • Invoices are sent by email; notification is made within 7 business days if payment fails.

4. User Obligations

  • The platform may only be used for lawful purposes.
  • The user is responsible for account security; password sharing is prohibited.
  • Reverse engineering, copying or unauthorized distribution of the platform is prohibited.
  • Unauthorized access attempts to other users' or third parties' data is prohibited.
  • Uploading malicious software or content that could damage the platform is prohibited.

5. Data Ownership

All data uploaded by the user to the platform (customer records, work orders, service forms, etc.) belongs to the user. FieldCo processes this data solely for the purpose of providing the service. Upon subscription termination, the user can export their data; data is permanently deleted after 30 days.

6. Service Level Agreement (SLA)

FieldCo commits to 99.9% monthly uptime for the platform. Planned maintenance is announced in advance. If this commitment is exceeded, the user may request service credit proportional to the affected period.

7. Intellectual Property

The FieldCo platform, interface, logo and content are the property of MOBIM Software and are protected under Turkish intellectual property legislation. The user is granted only a non-transferable, non-exclusive usage license limited to the subscription period.

8. Limitation of Liability

FieldCo shall not be liable for any indirect, incidental or consequential damages arising from the user's use of the platform. Maximum liability for direct damages is limited to the subscription fee paid for the relevant period.

9. Termination

The user may cancel the subscription at any time; cancellation takes effect at the end of the period. FieldCo may suspend or terminate the account without prior notice in case of breach of these terms.

10. Governing Law

These terms are governed by Turkish law. Istanbul Central (Çağlayan) Courts and Enforcement Offices are authorized in disputes.
